Terms of Service

Athleex is a SaaS platform that allows Personal Trainers to manage their athletes: creating training programs, tracking progress, chat, integrated billing, analytics. The Service is a management tool; it does not provide medical advice and cannot replace the opinion of a qualified physician.

• You must be at least 18 years old to register.
• You must provide truthful data and keep it up to date.
• Access credentials are personal and non-transferable. You are responsible for any activity carried out through your account.

Athleex offers free and paid plans. Payments are processed by Stripe and invoiced in advance. The subscription renews automatically unless cancelled before the end of the current period. Cancellation is possible at any time from the Billing section and takes effect at the end of the current period. No refund is due for the portion of the period already used, except where required by law (e.g. consumer right of withdrawal under Italian Legislative Decree 206/2005).

It is prohibited to:

• use the Service for unlawful, harassing, defamatory purposes or in a manner that infringes the rights of third parties;
• attempt unauthorised access, reverse engineering, massive scraping, DoS attacks or penetration testing not agreed in advance;
• upload content that infringes third-party rights or contains malware;
• send spam or unsolicited commercial communications through chat or the invitation system;
• use third-party personal data without being entitled to do so.

Violations may result in immediate suspension or closure of the account, without prejudice to Athleex's right to seek damages.

You retain full ownership of the content you upload (programs, photos, messages, notes). You grant Athleex a limited, non-exclusive and free licence solely for the purpose of providing the Service (storage, display, transmission). This licence ends when the content or the account is deleted.

Athleex is merely a management tool. The contractual relationship between the Personal Trainer and the athlete (professional services, liability, tax obligations) exists exclusively between the parties concerned. Athleex is not a party to such relationship and assumes no liability for the Personal Trainer's work or training outcomes.

The Service is NOT a medical device. Nutrition, biometric and training content do not replace the opinion of a qualified physician. Before starting any training program, you are advised to consult a doctor, particularly if you have medical conditions. Athleex disclaims all liability for any physical harm arising from use of the Service or from performing exercises.

To the extent permitted by applicable law, Athleex is not liable for indirect damages, data loss not attributable to its gross negligence or wilful misconduct, lost profits or Service interruptions. Athleex's total liability towards you shall not exceed the amount you paid in the 12 months preceding the event giving rise to the claim.

Athleex may suspend or terminate an account in case of breach of these Terms, non-payment, or upon order of judicial authorities. You can delete your account from Settings at any time. Deletion entails the erasure of personal data under the terms set out in the Privacy Policy.

Athleex reserves the right to update these Terms at any time. Material updates will be notified by email to registered users with at least 30 days' notice. Continued use of the Service after the notice constitutes acceptance of the changes.

These Terms are governed by Italian law. For any dispute, the court of the consumer's place of residence shall have exclusive jurisdiction, where applicable, or otherwise the court of Athleex's registered office for professional users.
